1. Who We Are

PHAT App (Private Hire And Taxi App) is operated by PHAT App Ltd, based in the United Kingdom. We are the data controller for the personal data we collect through this website and our mobile application.

Contact: hello@phatapp.co.uk | 01264 601144

If you have any questions about how we handle your data, please contact us using the details above. We take our obligations under UK GDPR and the UK Data Protection Act 2018 seriously.

2. Data We Collect

We collect the following categories of personal data:

  • Customers: Name, email address, phone number, location data (for ride tracking), and journey history.
  • Drivers & Firms: Full name, business name, address, contact details, National Insurance number, driving licence, operator licence, photo ID, selfie for verification, vehicle registration details, bank/direct debit information, and logo.
  • Website visitors: Contact form submissions, including name, email, and message content.

Special Category Data: Some data we collect from drivers (such as photo ID, selfies, and National Insurance numbers) may be considered sensitive personal data. We collect this only where strictly necessary for identity verification and licensing compliance, and handle it with the highest level of care and security.

3. How We Use Your Data

  • To process and manage driver/firm applications and onboarding
  • To connect customers with verified local drivers
  • To provide real-time ride tracking and journey safety features
  • To communicate application status updates, service information, and support
  • To comply with legal obligations (e.g. licensing, anti-fraud)
  • To improve our platform and services
  • To send marketing communications where you have given consent (you may opt out at any time)

4. Legal Basis for Processing

We process your data under the following UK GDPR lawful bases:

  • Contract: To fulfil our service to customers and drivers/firms (e.g. processing applications, managing bookings)
  • Legal obligation: Compliance with transport and private hire licensing laws, and financial record-keeping
  • Legitimate interests: Fraud prevention, platform security, and improving our services — where we have assessed these do not override your rights
  • Consent: Where you have explicitly provided it (e.g. marketing communications). You may withdraw consent at any time by contacting hello@phatapp.co.uk

5. Sharing Your Data

We do not sell your personal data. We may share data with:

  • Vetted third-party service providers (e.g. payment processors, cloud storage, email delivery) who process data on our behalf under data processing agreements
  • Regulatory bodies or law enforcement where legally required
  • Customers and drivers where necessary to complete a journey booking

6. International Data Transfers

Some of our third-party service providers may process your data outside the United Kingdom. Where this occurs, we ensure appropriate safeguards are in place in line with UK GDPR, such as the use of the UK International Data Transfer Agreement (IDTA) or equivalent protections. If you have questions about specific transfers, please contact us.

7. Cookies

Our website uses cookies to ensure it functions correctly and to understand how visitors use it. These may include essential cookies (required for the site to work) and analytics cookies (to help us understand usage patterns). By continuing to use our website, you consent to the use of essential cookies. For analytics cookies, we will seek your consent where required. You can manage or disable cookies through your browser settings at any time.

8. Automated Decision-Making

We do not make solely automated decisions about you that have a legal or similarly significant effect. Application reviews involve human assessment by our team. If this changes, we will update this policy and inform you of your rights accordingly.

9. Data Retention

We retain your data for as long as necessary to provide our services and comply with legal requirements. Driver application data is retained for a minimum of 6 years in line with UK financial and licensing record-keeping requirements. Customer journey data is retained for as long as your account is active plus a reasonable period thereafter. You may request deletion at any time, subject to our legal obligations to retain certain records.

10. Your Rights

Under UK GDPR and the Data Protection Act 2018, you have the right to:

  • Access: Request a copy of the personal data we hold about you (Subject Access Request)
  • Rectification: Correct inaccurate or incomplete data
  • Erasure: Request deletion of your data ("right to be forgotten"), subject to legal retention obligations
  • Restriction: Ask us to limit how we process your data in certain circumstances
  • Portability: Receive your data in a structured, machine-readable format
  • Object: Object to processing based on legitimate interests or for direct marketing
  • Withdraw consent: Where processing is based on consent, withdraw it at any time without affecting prior processing

To exercise any of these rights, contact us at hello@phatapp.co.uk. We will respond within one calendar month as required by law.

11. Security

We implement appropriate technical and organisational measures to protect your personal data against unauthorised access, loss, or disclosure. Sensitive documents (e.g. licences, ID) are stored securely and access is restricted to authorised personnel only. In the event of a data breach likely to risk your rights and freedoms, we will notify the ICO within 72 hours and inform affected individuals without undue delay.

12. Complaints

If you are unhappy with how we handle your data, please contact us first so we can try to resolve it. You also have the right to lodge a complaint with the UK Information Commissioner's Office (ICO) at ico.org.uk or by calling 0303 123 1113.
