1. About PHAT App

PHAT App (Private Hire And Taxi App) is a platform that connects customers with vetted, local independent private hire drivers and firms across the United Kingdom. These Terms of Service govern your use of our website at phatapp.co.uk and our mobile application.

By accessing or using PHAT App, you agree to be bound by these terms. If you do not agree, please do not use our services.

2. Eligibility

• You must be at least 18 years of age to use PHAT App.
• Drivers and firms must hold valid UK private hire or taxi licences and comply with all applicable licensing requirements.
• You must provide accurate and truthful information when registering or applying through the platform.

3. For Customers

• PHAT App connects you with independent drivers and firms. We are a technology platform and are not a transport provider ourselves.
• All drivers listed on the platform are vetted and hold appropriate licences, but PHAT App does not guarantee the availability of any specific driver.
• You are responsible for providing accurate pickup and drop-off locations.
• Journey pricing is agreed between you and the driver/firm at the point of booking.

4. For Drivers & Firms

• You must hold a valid UK private hire operator licence (where applicable) and ensure all vehicles and drivers comply with local authority licensing requirements.
• You are an independent contractor, not an employee of PHAT App.
• You are responsible for all bookings accepted through the platform and for the quality of service provided to customers.
• Subscription fees are charged weekly. Failure to maintain payments may result in suspension of your account.
• You must not use the platform to engage in fraudulent, misleading, or unlawful activity.
• PHAT App reserves the right to suspend or terminate your account if you breach these terms or if your licences lapse.

5. Subscription & Payments (Drivers/Firms)

The subscription fee is £50 per week (ex. VAT), with 0% PHAT commission on your fares. This £50 weekly rate is protected for the first 24 months from your onboarding date, subject to the terms of your agreement at that time. The setup fee of £149.99 is currently waived. PHAT App reserves the right to change pricing with reasonable notice.

6. Prohibited Conduct

You must not:

• Use PHAT App for any unlawful purpose
• Impersonate another person or entity
• Submit false or misleading information
• Attempt to reverse-engineer, hack, or disrupt the platform
• Harass, threaten, or abuse other users, drivers, or PHAT App staff

7. Intellectual Property

All content on this website and the PHAT App application, including logos, text, and software, is the property of PHAT App Ltd and is protected by UK copyright law. You may not reproduce or distribute any content without our written permission.

8. Limitation of Liability

PHAT App is a technology intermediary. To the maximum extent permitted by law, we are not liable for any loss or damage arising from:

• The conduct of drivers or firms on the platform
• Journey delays, cancellations, or disputes between customers and drivers
• Technical failures or interruptions to the service

Nothing in these terms limits our liability for death, personal injury, or fraud caused by our negligence.

9. Governing Law

These Terms of Service are governed by the laws of England and Wales. Any disputes shall be subject to the exclusive jurisdiction of the courts of England and Wales.
